Terms and Conditions of Sale

These Terms and Conditions of Sale govern the online purchase of products from Rudy Project S.p.A., with registered office at Via Benedetto Marcello 44, 31100 Treviso (TV), Italy – VAT No. IT02043750260 – REA TV-186565 – email: info@rudyproject.com (“Seller”), through the website www.rudyproject.com (“Website”).
By placing an order through this Website, you (“Customer” or “Buyer”) agree to be bound by the following Terms.
1. Object and Scope
1.1 These Terms apply to all distance sales of Rudy Project products made through the Website.
1.2 The Website offers sports and outdoor products designed, manufactured, and distributed by Rudy Project.
1.3 Product descriptions, features, and prices are displayed on each product page. Images are provided for illustrative purposes and may differ slightly from the actual product due to technical limitations of digital display.
1.4 The sale is intended exclusively for consumers (B2C) acting for purposes unrelated to their professional or business activity.
2. Acceptance of the Terms
2.1 Before placing an order, the Customer must read and accept these Terms. Placing an order implies full and unconditional acceptance.
2.2 The order is completed through the Shopify checkout process by clicking the “Pay Now” or equivalent confirmation button, which constitutes a binding order with an obligation to pay.
2.3 The Customer is responsible for the accuracy of all data entered during checkout, including billing, shipping, and contact information.
2.4 Rudy Project reserves the right to refuse or cancel orders for legitimate reasons, such as product unavailability, payment authorization issues, or suspected fraud.
3. Prices and Payment
3.1 All prices are displayed in Euro (EUR) and include VAT and other applicable taxes, unless otherwise stated.
3.2 The total amount payable (“Total Price”) includes product price(s), applicable taxes, and shipping costs displayed before order confirmation.
3.3 Payment can be made securely using the methods supported by Shopify, including:

Credit and debit cards (Visa, Mastercard, American Express, etc.)

Apple Pay, Google Pay, or other alternative payment gateways where available.
3.4 The payment is processed at the time of order confirmation.
3.5 Rudy Project reserves the right to modify prices at any time, provided that the applicable price is the one displayed at the time of purchase.
4. Order Confirmation and Contract Conclusion
4.1 After submitting the order, the Customer will receive an automatic email confirmation summarizing the purchase details.
4.2 The sales contract is concluded once Rudy Project sends the Order Confirmation email.
4.3 If one or more items are unavailable, Rudy Project will inform the Customer and refund any amounts paid for unavailable products.
4.4 Orders are processed and shipped only after successful payment authorization.
5. Shipping and Delivery
5.1 Products are delivered to the address specified by the Customer during checkout.
5.2 Shipments are handled by professional couriers selected by Rudy Project. Delivery times vary depending on the destination, generally within 3–5 working days within the EU and up to 15 working days outside the EU.
5.3 Delivery times are estimates and not guaranteed. Delays may occur due to customs procedures, local holidays, or unforeseen circumstances.
5.4 The Customer must verify the integrity of the package upon delivery and report any damage or discrepancy immediately to the courier and Rudy Project’s Customer Service.
5.5 If the Customer is absent at delivery, a notification will be left with instructions for re-delivery or pick-up.
5.6 Shipping Costs and Conditions:
- For most EU countries, orders below €100 are subject to a flat shipping fee of €10. Orders of €100 or more qualify for free shipping.
- For deliveries to Malta, Cyprus, and the Canary Islands, a flat shipping fee of €30 applies to orders below €150. Orders of €150 or more qualify for free shipping.
5.7 Shipping costs are displayed before order confirmation and form part of the total amount payable (“Total Price”).
5.8 Rudy Project reserves the right to apply temporary free-shipping promotions, which will be clearly indicated on the Website at the time of purchase.
5.9 Customs duties or import taxes, if applicable outside the European Union, are not included and remain the Customer’s responsibility.

6. Right of Withdrawal (Returns Policy)
6.1 Under EU law, the Customer has the right to withdraw from the contract without giving any reason within 14 days from the date of delivery.
6.2 To exercise this right, the Customer must notify Rudy Project by email at ecommerce@rudyproject.com or by using the return form available on the Website.
6.3 Returned products must be shipped within 14 days from the withdrawal notice and in their original condition, unused, with all packaging, tags, and accessories intact.
6.4 Return shipping costs are borne by the Customer unless otherwise stated in promotional offers.

6.6 Refunds will be issued using the same payment method used for the original transaction within 14 days of receipt and inspection of the returned goods.
6.7 The right of withdrawal does not apply to customized or personalized products, or to items that cannot be returned for hygiene reasons (e.g., used sportswear, prescription inserts).
7. Legal Warranty and Customer Assistance
7.1 All Rudy Project products are covered by a 2-year legal warranty against manufacturing defects, in accordance with the EU Consumer Code (Legislative Decree 206/2005).
7.2 The warranty covers non-conformities existing at the time of delivery. It does not cover damage due to misuse, negligence, or improper maintenance.
7.3 To make a warranty claim, the Customer must contact Customer Service via customerservice@rudyproject.com or the “Contact” section of the Website, providing proof of purchase and a description of the defect.
7.4 Rudy Project will assess the claim and may offer repair, replacement, or refund, depending on the case.
8. Limitation of Liability
8.1 Rudy Project shall not be held liable for delays, non-performance, or damages due to force majeure (e.g., natural disasters, strikes, internet outages, etc.).
8.2 The Seller is not liable for indirect, incidental, or consequential damages related to the use or inability to use the Website or products purchased.
8.3 Rudy Project’s total liability shall in no case exceed the amount paid by the Customer for the purchased product.
9. Personal Data Protection
9.1 Rudy Project processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national laws.
9.2 The Customer’s data are collected and processed for purposes related to order fulfillment, payment, shipment, and customer assistance.
9.3 Detailed information is available in the Website’s Privacy Policy, which forms an integral part of these Terms.
9.4 Shopify acts as a data processor for transactions and hosting; data may be transferred outside the EU in compliance with GDPR safeguards.
10. Applicable Law and Jurisdiction
10.1 These Terms and any dispute arising from the use of the Website or purchase of products shall be governed by Italian law, excluding conflict-of-law principles.
10.2 If the Customer is a consumer resident in the EU, jurisdiction is determined by the Customer’s place of residence.
10.3 If the Customer is not a consumer or resides outside the EU, exclusive jurisdiction shall lie with the Court of Treviso (Italy).
11. Final Provisions
11.1 These Terms supersede any previous agreements or communications regarding the same subject.
11.2 If any clause is found invalid or unenforceable, the remaining provisions shall continue to apply.
11.3 The English version of these Terms shall prevail in case of discrepancies with translations.

By confirming the order through the Website, the Customer declares to have read, understood, and expressly accepted these Terms and Conditions of Sale.
